Terms of Service
Last updated: October 14, 2026
1. Who We Are and What These Terms Cover
Think and Automate, LLC (“Think & Automate,” “we,” “us,” or “our”) provides lead generation, pay-per-lead and pay-per-appointment programs, paid advertising management, fractional CMO, website and funnel development, software integration, and dashboard services, along with software we operate, including AIO (attribution and marketing analytics) and the AI Appointment Setter (together, the “Apps”).
These Terms of Service (the “Terms”) govern your use of thinkandautomate.com and any linked application, scheduling, checkout, client portal, or app pages (the “Site”), the Apps, and any services we provide (together with the Site and Apps, the “Services”). By using the Services, creating an account, accepting an invitation, or signing a proposal or order, you agree to these Terms. If you use the Services for a business, you agree on behalf of that business and confirm you have authority to do so.
If you have a separate signed agreement, proposal, or order form with us, that document controls where it conflicts with these Terms.
2. Accounts, Logins, and Invitations
Some Services require an account. You agree to give accurate information, keep your login credentials confidential, and tell us right away at corey@thinkandautomate.com if you believe your account has been accessed without permission. You are responsible for activity under your account.
Account owners and admins may invite other people to their account and choose which Apps and features each person can use, within what their plan includes. You are responsible for the people you invite and for removing access when it is no longer needed. Invitation links are personal and may expire or be limited to a single use; do not share them.
Think & Automate staff may access your account to provide support, set up, and manage the Services you have engaged us for. Staff access is limited to that purpose and is logged.
3. Our Services and Your Responsibilities
We will perform the Services described in your proposal, order, or plan with reasonable skill and care. Timelines are estimates and depend on you providing timely access, approvals, content, and information.
You agree to provide accurate information about your business, offers, and pricing; to keep the access we need to your ad accounts, websites, CRMs, calendars, and other tools; and to review and approve ads, copy, and pages before they run when we ask you to. You are responsible for your products and services, the claims made about them, and fulfilling your obligations to your own customers.
4. Fees, Billing, and Ad Spend
You agree to pay the fees in your proposal, order, or plan. Unless stated otherwise, fees are billed in advance, are in U.S. dollars, and are non-refundable. Recurring plans renew automatically each billing period until canceled. You authorize us and our payment processor to charge your payment method on file for all amounts due.
Advertising spend paid to platforms such as Meta, Google, or TikTok is separate from our fees unless your agreement says otherwise. You are responsible for ad spend charged to your ad accounts. For pay-per-lead or pay-per-appointment programs, what counts as a billable lead or appointment, and how disputes or replacements are handled, is set out in your program terms.
Late payments may result in paused Services. We may change pricing for future billing periods with at least 30 days’ notice.
5. No Guaranteed Results
Marketing results depend on many factors outside our control, including your offer, pricing, sales process, follow-up, market conditions, and the policies and algorithms of advertising platforms. Unless a written guarantee is included in your signed agreement, we do not guarantee any specific number of leads, appointments, sales, revenue, return on ad spend, or other outcome. Reports, predictions, and recommendations from our team or the Apps (for example, attribution reports, Pilot moves, or Briefing decisions) are estimates to help you decide, not promises.
6. Texting, Calling, and Marketing Compliance
If you use the Services, including the AI Appointment Setter, to send texts, place calls, or send emails, you are responsible for having the consent and legal basis required to contact each person, for honoring opt-outs, and for complying with applicable laws and carrier rules, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and state telemarketing and privacy laws. You agree not to upload or contact numbers or addresses you do not have permission to contact.
You also agree that your ads, landing pages, and offers will comply with the policies of the platforms they run on and with laws on advertising claims, including those enforced by the Federal Trade Commission. We may pause or refuse to run content that we believe violates a law or a platform’s rules.
7. Acceptable Use
You agree not to use the Services to break any law; send spam or unsolicited messages; infringe anyone’s rights; upload malware; attempt to access accounts, data, or systems you are not authorized to access; interfere with or overload the Services; scrape or copy the Apps; reverse engineer the Apps except where the law allows; or resell or share access to the Apps outside your account without our written permission.
8. Your Data and Content
You keep ownership of the data and content you provide or that the Services collect for you, such as leads, conversion data, call recordings and transcripts, ad creative, and copy (“Your Data”). You grant us a limited license to host, process, and use Your Data to provide, secure, and improve the Services for you. We handle personal information as described in our Privacy Policy.
You confirm you have the rights and consents needed to provide Your Data to us, including notifying and obtaining consent from people whose calls are recorded where the law requires it. We may use aggregated, de-identified information that does not identify you or any individual to operate and improve the Services.
9. AI Features
Some features use artificial intelligence, including to write ad copy, generate or edit images, transcribe and score calls, and hold conversations with leads. AI output can be inaccurate or incomplete. You are responsible for reviewing AI-generated content before you publish or rely on it, and for the claims it makes about your business. Where AI features use third-party model providers, Your Data is shared with them only as needed to provide the feature.
10. Third-Party Platforms
The Services connect to third-party platforms such as Meta, Google, TikTok, Stripe, Shopify, GoHighLevel, Zoom, calendar providers, and AI model providers. Your use of those platforms is governed by their terms. We are not responsible for their availability, policy changes, account restrictions or suspensions, data accuracy, or charges, and connecting an account to the Services authorizes us to access it as needed to provide the Services.
11. Intellectual Property
The Site, the Apps, and our methods, templates, software, and materials (including frameworks such as the Proof Loop and the Call Ladder) are owned by Think & Automate and protected by law. We grant you a limited, non-exclusive, non-transferable right to use them during your subscription or engagement for your internal business purposes.
Once paid in full, you own the final deliverables we create specifically for you under your agreement, such as ad creative, copy, and website content, excluding our pre-existing materials, software, and third-party assets, which remain licensed to you for use with those deliverables. If you send us feedback or suggestions, we may use them without obligation to you.
12. Confidentiality
Each of us may share non-public information with the other. We will each use the other’s confidential information only to perform under these Terms and protect it with reasonable care, except where disclosure is required by law.
13. Disclaimers
Except as expressly stated in a signed agreement, the Services are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that the Services will be uninterrupted, error-free, or that data will be complete or accurate.
14. Limitation of Liability
To the fullest extent allowed by law, Think & Automate will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, or for advertising spend, even if we were told they were possible. Our total liability for any claim relating to the Services is limited to the fees you paid us for the Services giving rise to the claim in the three (3) months before the event that caused it.
15. Indemnification
You agree to defend and indemnify Think & Automate and its owners, employees, and contractors against claims, losses, and expenses (including reasonable attorneys’ fees) arising from your products, services, or advertising claims; Your Data; your texting, calling, or emailing practices; or your breach of these Terms or the law.
16. Cancellation, Suspension, and Termination
You may cancel a recurring plan at any time, effective at the end of the current billing period, unless your agreement sets a minimum term or notice period. We may suspend or end your access if you do not pay, break these Terms, or create legal or security risk for us or others. When the Services end, your right to use the Apps ends; you can ask us within 30 days to export Your Data that we still hold, after which we may delete it. Sections that by their nature should survive (including fees owed, data, intellectual property, disclaimers, limitation of liability, and indemnification) survive termination.
17. Governing Law and Disputes
These Terms are governed by the laws of the state in which Think and Automate, LLC is organized, without regard to its conflict-of-law rules. Before filing a claim, each of us agrees to try to resolve the dispute informally by contacting the other in writing and allowing 30 days to resolve it. Any claim must be brought in the state or federal courts located in that state, and each of us consents to their jurisdiction.
18. Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms on this page with an updated “Last updated” date, and for material changes we will give reasonable notice by email or in the Apps before they take effect. Continuing to use the Services after the changes take effect means you accept them.
